NO PURCHASE NECESSARY TO ENTER, WIN OR CLAIM A PRIZE. A PURCHASE OR PAYMENT WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING. VOID WHERE PROHIBITED. INTERNET ACCESS REQUIRED.
1) Sweepstakes Entry Period: The Gatorade x Casey’s Equity in Sports Sweepstakes (the “Sweepstakes) begins at approximately 12:00:00 PM Eastern Daylight Time (“EDT”) on September 4, 2024, and ends at 11:59:59 PM EDT on October 1, 2024 (the “Sweepstakes Entry Period”). During the Sweepstakes Entry Period, there will be three (3) separate calls to action posted (in-feed posts) to enter the Sweepstakes (a “CTA Post”) from the @Caseys Instagram account. As soon as the applicable CTA Post is issued, eligible entrants may participate in the Sweepstakes as provided herein.
2) Eligibility: To be eligible to participate, an entrant must, as of the date and time of participation, be: (a) a legal U.S. residents of one of AR, IL, IN, IA, KS, KY, MI, MN, MO, NE, ND, OH, OK, SD, TN or WI (the “Sweepstakes Territory”); and (b) 13 years of age or older (each, an “Entrant(s)”). Entrants also need to have a personal Instagram account. If you do not have an Instagram account, you may create a free account at https://www.instagram.com. Employees, officers, directors and agents of The Gatorade Company (“Sponsor”) their respective bottlers, parent companies, subsidiaries, affiliated companies, and divisions, Casey’s Stores any other company involved in the presentation, administration or fulfillment of this Sweepstakes (collectively, the “Sweepstakes Entities”) and each of their respective immediate family members (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) and/or those living in the same household members (whether or not related) are not eligible to enter or receive a prize in the Sweepstakes. Void outside the Territory and where prohibited or restricted by law.
3) How To Participate in the Sweepstakes: To participate in the Sweepstakes, you must be a registered user of Instagram and follow the handle @Caseys on Instagram.com. To create a free Instagram account, follow the onscreen instructions to register on the app or at http://Instagram.com. To become a follower of @Caseys, visit Instagram.com/caseys and choose to follow. You must follow @Caseys on Instagram for the duration of the Sweepstakes. Your Instagram setting must be set to “unprotected” and “public” in order for your Entry to be viewable by Administrator and allow direct messages from anyone so that you may be contacted by Administrator if you are selected as a potential winner.
After a CTA Post is made on the Instagram Account listed in Rule 1 during the Sweepstakes Entry Period, you may enter by completing the following steps: (a) comment on the applicable CTA Post with a lightning bolt emoji and a pizza emoji; (b) include the hashtags #GatoradeCaseysSweepstakes with your comment; and (c) follow the @Caseys Instagram account.
Once you have complied with all of the entry requirements set forth above, you will receive one (1) entry into the Sweepstakes.
Limit of one (1) Sweepstakes entry per post per Instagram Account during the Sweepstakes entry period, giving each Instagram account a limit of three (3) entries during the Sweepstakes Period.
Each Entry submission must be manually key stroked and/or manually entered by the individual entrant; automated and/or repetitive electronic submission of Entries (including but not limited to Entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from such scripts, macros, bots or sweepstakes services or related social media accounts or IP addresses may be blocked. If more than one (1) entry is submitted on the same CTA Post, only the first entry will be considered valid. If it is discovered that an entrant used multiple social media accounts or manipulated their contact information, for the purpose of obtaining more than the stated number of Entries, such persons will be disqualified and all of their Entries shall be deemed invalid and any prize awarded to them shall be forfeited.
Sponsor is not responsible for misspellings, typographical errors, or other issues that may affect the ability to locate or record an Entry. Entry must comply with these Official Rules and the Instagram Terms of Use and Community Guidelines found at https://www.instagram.com/legal/terms. In the event of a conflict between the Sweepstakes Official Rules and Instagram Terms of Use and Community, the Sweepstakes Official Rules shall govern.
Any Entry or portion thereof that is, in the Sponsor's sole discretion, inconsistent with Sponsor's desired image, offensive, obscene, profane, lewd, defamatory, contains any proper names, third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand (other than Sponsor’s) or other proprietary right of any entity or person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light), or is otherwise objectionable, will not be accepted as an Entry and may disqualify entrant from further participation in the Sweepstakes.
All entrants must have a valid email address. The name of the person submitting the entry into the Sweepstakes must be the authorized account holder of the email address (or associated with the social media account) used to enter or entry may be deemed void. Multiple entrants may not share the same email address or social media account. In the event of a dispute over the identity of an entrant, the Entry will be declared made by the authorized account holder of the email address associated with the Entry submitted. The potential winner may be required to provide identification sufficient to show that they are the authorized account holder of such account.
If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. Mobile entry is not required to submit an Entry or win a prize in this Sweepstakes.
4) Prizes/Donations:
Sixty-one (61) Prizes will be awarded, each consisting of one (1) $150 Casey’s Gift Card and one (1) limited edition Gatorade Shirt. Approximate Retail Value (“ARV”) of each Prize: $190.
For each Prize awarded, there will be a $50 donation made to RISE. Once all Prizes are awarded, one (1) donation will be made to RISE for $3,050. Winners’ names/contact information will not be supplied to the charitable organization. Sponsor will have no further obligation to Entrant. Note: Only the Sponsor will make the donation to RISE, in Sponsor’s name only. Entrants are not making any donations in the Sweepstakes and will not receive a receipt nor will they be eligible to claim any charitable deductions on their tax returns as a result of this Sweepstakes. Total ARV of all Prizes available in this Sweepstakes: $11,590.
Limit of one Prize per person, email address, Instagram account or mailing address in connection with the Sweepstakes. Odds of winning a Prize in this Sweepstakes depend on the number of eligible entries received. Any federal, state and local taxes on the Prizes, and any other expenses associated with the Prizes that are not expressly included in the Prize description herein, are the sole responsibility of each Prize winner. Each Prize is nontransferable and may not be substituted or redeemed for cash by Prize winner. Sponsor reserves the right to substitute a Prize (or component thereof) of equal or greater value if the advertised Prize (or component thereof) becomes unavailable for any reason. All Prize details will be determined by Sponsor in its sole discretion. No more than the stated number of Prizes will be awarded. If more than sixty-one (61) prize notifications are issued due to a human, technical or other error, the sixty-one (61) intended Prizes will be awarded in a random drawing from among all recipients of such notifications.
5.) Prize Drawing/Winner Notification: On or about October 1, 2024, an independent judging organization chosen by the Sponsor will conduct a random prize drawing to select sixty-one (61) potential winners from among all eligible entries received through the CTA Posts to receive the prize package described in Rule 4 above (subject to verification of eligibility and compliance with these Official Rules. If you are chosen as a potential Prize winner, you will receive a winning notification via Instagram direct message from the @Caseys Instagram account and may be required to provide your complete home mailing address via direct message reply and/or send an email to an email address provided in the direct message within three (3) days. If any message intended for a winner is returned as undeliverable or is not replied to within the three (3) days, then the applicable Prize may be forfeited. Potential winners may be required to sign and return on behalf of the Sponsor, as applicable, for its/their receipt within three (3) business days, a W9, Affidavit of Eligibility/ Liability Release and (where lawful) a Publicity Release, for any prize over $599
Prize(s) will be awarded and sent only to winners with addresses within the Sweepstakes Territory. Sponsor is not responsible for any delay or cancellation of the Prize delivery due to unforeseen circumstances, or those outside of Sponsor’s control, as applicable. Potential winners are subject to verification before Prizes will be awarded.
6.) Limitation of Liability: By participating in this Sweepstakes, entrants agree that the Sweepstakes Entities and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees, agents, its parents and affiliates (“Released Parties”) are not responsible for: (i) lost, late, incomplete, stolen, misdirected or undeliverable e-mail or direct message notifications; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate capture of entrant’s information or the failure to capture, or loss of, any such information; (vi) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes; (vii) any injury or damage, whether personal or property, to entrants or to any person's computer related to or resulting from participating in the Sweepstakes and/or accepting a prize; and (viii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules. Further, the Sweepstakes Entities are not responsible for any unanswered or undeliverable winner notifications.
By participating in the Sweepstakes, each entrant agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstakes; and (iii) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Sweepstakes-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Sweepstakes; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant.
If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend the Sweepstakes or proceed with the Sweepstakes, including the selection of a winner in a manner it deems fair and reasonable, including the selection of a winner from among eligible entries received prior to such cancellation, termination, modification or suspension. In no event will more prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Sponsor shall not have any further liability to any entrant in connection with the Sweepstakes. Sponsor may modify and amend these Official Rules as they appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
7.) Disputes: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ILLINOIS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE RESOLVED IN THE STATE OF ILLINOIS IN A COURT OF COMPETENT JURISDICTION. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN ILLINOIS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN COOK COUNTY, ILLINOIS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR SWEEPSTAKES ENTITIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE Sweepstakes PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

Publicity Rights: By participating in this Sweepstakes, each entrant agrees to allow the Sponsor and Sponsor’s designee the perpetual right to use their name, address (city and state), biographical information, likeness, picture and other information and content provided in connection with the Sweepstakes for promotion, trade, commercial, advertising and publicity purposes in all media worldwide including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation, except for residents of Tennessee and where prohibited by law.
10.) General: Any attempted form of participation in this Sweepstakes other than as described herein is void. Sponsor reserves the right to disqualify any entrant found or suspected, in their sole and absolute discretion, to be tampering with the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Sweepstakes. Any attempted form of participation in this Sweepstakes other than as in these Official Rules is void. If it is discovered that a person has registered or attempted to register more than once using multiple phone numbers, e-mail addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s entries will be declared null and void and that person will not be awarded any prize that he/she might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. Entrants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor or Administrator In the event of a dispute as to the identity of a winner, the winning entry will be declared made by the authorized account holder of the e-mail address submitted on the registration form associated with such entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution) that is responsible for assigning email addresses for the domain associated with the submitted email address. Each entrant may be required to show proof of being an authorized account holder. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No entrant shall have the right to modify or amend these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any Sweepstakes details contained in these Official Rules and Sweepstakes details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail. 11.) Winners’ List: For a list of winners, interested individuals should mail a self-addressed stamped business envelope to: Gatorade x Casey’s Equity in Sports Social Sweepstakes Winners’ List, P.O. Box 536986, Orlando, FL 32853-6986. Winner List requests must be received no later than November 1, 2024.
